Welcome to Smart Controls USA. By accessing and using our website and services, you agree to comply with and be bound by the following terms and conditions. Please review these terms carefully. If you do not agree to these terms, you should not use this website or our services.

1. General Information

Smart Controls USA operates as a security solutions provider based in Henderson, Nevada. We offer a range of services, including CCTV & video surveillance systems, access control systems, intercom installations, Video intercoms, electrified doors and hardware, networking hardware installs (PoE switches, patch panels, racks, etc.), 3rd party VMS, CCTV, and security camera systems for commercial and residential properties. These terms and conditions govern your use of our website and services.

2. Service Eligibility

To be eligible for our services, you must:

  • Provide accurate, complete, and current information when requesting services.
  • Have the legal capacity to enter into binding contracts.

We reserve the right to refuse services to any individual or business at our discretion.

3. Scope of Services

Smart Controls USA provides security system consultations, installations, maintenance, and support. Our services include but are not limited to:

  • CCTV installation and video surveillance systems.
  • Access control systems for managing entry points.
  • Intercom systems for enhanced communication and security.
  • Ongoing support and maintenance packages for all installed systems.

The exact services provided will be outlined in individual contracts signed by the client and Smart Controls USA.

4. Pricing and Payments

  • Quotations: Prices for our services are provided through detailed quotes based on the specific requirements of each client. All prices are subject to change until the quote is formally accepted by the client.
  • Payment Terms: A deposit is required before any installation work begins. The remaining balance is due upon completion of the project unless otherwise stated in the contract. Accepted payment methods include credit/debit cards, wire transfers, and other electronic payment methods as specified on the invoice.
  • Late Payments: Late payments will incur a penalty of 5% per month on the outstanding amount. Smart Controls USA reserves the right to suspend services until payments are fully settled.

5. Installation and Project Timelines

  • Installation Schedule: Smart Controls USA will work closely with clients to schedule installation dates. However, we are not responsible for delays caused by factors beyond our control, including inclement weather, third-party issues, or availability of required equipment.
  • Permits and Compliance: The client is responsible for obtaining any permits or approvals required for the installation of security systems in accordance with local laws and regulations in Henderson, Nevada.

6. Maintenance and Support

  • Warranty: Our systems come with a limited warranty, typically covering one year from the installation date. During this period, we will repair or replace any faulty components free of charge, provided the issue is not caused by misuse or damage by the client.
  • Extended Support: After the warranty period, clients may purchase extended support or maintenance packages at an additional cost.
  • Exclusions: The warranty does not cover damage caused by natural disasters, misuse, tampering, or unauthorized alterations to the system.

7. Customer Responsibilities

  • Site Preparation: The client is responsible for ensuring that the installation site is ready and free from obstructions.
  • System Operation: It is the client’s responsibility to use the system as instructed. Any misuse or failure to follow instructions that result in damage will void the warranty and require repair at the client’s expense.

8. Cancellation and Refund Policy

  • Service Cancellations: If you need to cancel an installation or service, you must notify Smart Controls USA at least 48 hours before the scheduled appointment. Cancellations within 48 hours may incur a cancellation fee equivalent to 10% of the project cost.
  • Refunds: Refunds are available only for services not yet rendered. Refund requests must be submitted within 14 days of payment. We do not provide refunds for completed services, but we will work to resolve any issues that may arise.

9. Liability and Limitations

  • No Guarantees: We do not guarantee that our systems will prevent all unauthorized access, theft, or damage. Our systems are designed to reduce risks but are not a substitute for diligent property management.
  • Liability Limitations: Smart Controls USA is not liable for any indirect, consequential, or punitive damages resulting from the use or inability to use our systems, including any loss of data, property, or revenue.
  • Force Majeure: We are not liable for delays or failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to acts of God, government actions, or supply chain disruptions.

10. Privacy and Data Protection

We take the privacy of our clients seriously and are committed to protecting any personal information you provide to us. Please review our Privacy Policy for more details on how we handle and protect your data.

11. Governing Law

These terms and conditions are governed by the laws of the State of Nevada, without regard to its conflict of law principles. Any disputes related to these terms shall be resolved in the courts located in Henderson, Nevada.

12. Amendments

Smart Controls USA reserves the right to update or modify these terms and conditions at any time. Any changes will be posted on our website, and your continued use of our services constitutes acceptance of the revised terms.
